On 4 September 1940, by communiqué no. 91/1940 24, the Head of State, King Carol II, accepts the resignation of the Government of Prime Minister Ion Gigurtu, and instructs General Ion Antonescu to form a new Government. On 5 September, Royal Decree 3051/4 September 1940 is issued, accepting the resignation of Gigurtu's government and appointing General Ion Antonescu as Prime Minister. From a constitutional point of view, nothing special so far. But 5 September 1940 begins in the history of Romania a new institution of government; “ The National Legionary State”. installed without the constitutional support of any of the three Constitutions issued during the reign of the the three sovereign kings of the Hohenzollern-Sigmaringen Romania Dynasty.

 By the following decree, no. 3053/1940, published on the same page of the same Official Gazette, no. 205/5 September 1940, after the communiqué no. 92/1940 stated that the new Prime Minister had been sworn in at 3:50 a.m. the Head of State invests Prime Minister Ion Antonescu with "full powers to direct the Romanian state" by the first article.
